    Amendments were made during the proceedings of the case, Government amended NMW 1999 to Regulations 2000 S1 2000/1989.
    This amendment was enforced on October 1st, 2000.
    Main points of amendments in this regulation are:
    • Work Time is the time worker is available on work spot or near by the work place, except at worker's home or where workers home is near the work place or where the worker is allowed to have and spend some spare time at his home.
    • When worker is allowed to sleep at work place, worker should be provided reasonable place and facility to sleep accordingly. However worker's Work Time will start only when worker gets up for working purpose.
    • When a worker is near work or at home waiting for a call to work, will be considered as worker's work time. When workers is near the work place, at his home or spending time he is allowed to spend at home, will include in his work time. New amended added that 'any time worker is allowed to spend at home' makes it more applicable and appropriate and chances of fraudulent are reduced with this amendment in regulation. Now workers of factories and super mart who live near their workplace cannot claim their 24 hours as work time due to their availability near to the work place.
    • A worker sleeping during work is further clarified and employers are directed to provide a suitable sleeping environment to the employee in this amendment. But this arrangement and sleep do not include in work time. Work time will be starting with person is awake for the purpose of working.
    These amendments further describe the details of such conflicting and confusing clauses on one side and narrate the role of employees and employers more clearly. Secondly it proves that in this case Rg15(1) was not a relevant provision for this case.
