It is at least 8 weeks and before that is illegal in most states anyway though with very small dogs (and many other breeds actually) many are kept until 10 to 12 weeks due to health concerns like hypoglycemia and possibly liver shunts and better behavior as pets and companions and many, many things like that. There is some very important developmental and behavioral foundations set with the mother and littermates during this time (not to mention health) that can only be learned by being and interacting with them during this time. If they are taken too early not only could it affect their health, but they could have life long behavioral issues (that can't be corrected because the foundation wasn't there) that aren't fair to anyone including the pups since it didn't have to be that way. Among other things they learn the meaning of NO (we can only teach them the word but the meaning has to come from that time with mom), pack placement allowing a human to become pack leader, and bite inhibition. There are some things we just can't teach them.
