My Son Has Guardianship For 15 Years From My Parents, Can I The Biological Mother Take My Son Back?

    In some states a biological mother can recover custody of a child under the age of 18. However, the circumstances under, which parents became the guardians of your son will have control, over your chances for regaining guardianship.

    You would need to discuss your case completely and honestly with an attorney. Only such a person would now the laws of your state. Secondly, you would need to determine, if your son wants you to regain custody. Thirdly, if your parents believe this would be best for your son, they could surrender their role as guardians. If your parents are unwilling to surrender their guardianship rights, you would have a very difficult time struggle ahead of you.

    Cases such as your's are often difficult cases, however, if your son wants you to regain your parental rights, and become his custodial parent, then perhaps you can find an attorney who will work with you on a contingent basis.
