    My Niece Invited My Family And I To Stay With Her Rent Free (no Verbal Or Contract Agreement) Now We Moved Out And She Insists On Back Rent..do I Have To Pay?

    My brother recently came into some money(he lives 2 hrs away) and he and his wife insisted that we move up there so he can put my 3 children through really great private schools. I was hesitant because i know how it is when you live too close to family, but i gave it a try for the kids. My niece and her husband (no kids) insisted that we stay with her in her 3 bedroom house. Long story short it didnt work out and now she insist that we pay her back rent.

    You seem like a free loader to me. You lived for free at your nieces house with three children... Don't you think out of consideration you would want to give your niece something for the fact that your kids had a place to sleep, take a shower and eat? Now that someone else in the family "came into money" you're moving in with them to again live for free. You didn't specify what exactly happened that "didn't work out" at your nieces house but I would assume she might of gotten tired of supporting you and your three kids. Wouldn't you have some kind of a job with three children? Couldn't you of at least offered to do something in return for living there? Bottom line is your niece can't legally do anything about the money she is asking for however continuing to live off of others when you are a grown woman with three kids will probably never work out.

    I agree with C-girl and think that the easiest way out of this situation would be for the adults to sit down and agree on an amount, pay your niece and her husband and move on. I really don't think it's worth all the aggravation you're getting from the situation.

      Unfortunately often times people ruin their relationships with relatives or friends over money matters. When there is no contract of any sort, you are not obligated to pay her rent. She can't force you to give her rent and I wouldn't lose sleep thinking about it. However, I would rethink your relationship with your niece. Sometimes you don't see a person's true character until something happens.
      I had that happen to me before too but in a bit diff situation. To make the long story short, my mother bought the house we live in now from my grandmother and my mother's sisters. She gave the money to both of her sisters already and when my mother wanted to give my grandmother her share, she said she doesn't want the money (no written contract, only verbal). All she wants is her master bedroom as long as she is still living. Which was fine with my mother back then. And now 14 years later, grandma wants the money back because we don't get along anymore and she wants to move out. She demanded a third of the value of what the house is worth now. I refused to give her the money and offered her what her share was back 14 years ago. I told her take it or leave it. She took it. The point is, people can't just turn around and demand for money because things didn't work out the way they hoped. To me, a verbal contract is as good as a written one (that doesn't work in the legal system tho) because it's about honesty and character. If she wants to be a b**tch about it you dont have to be nice either.

      Her neice isn't being a b*tch about anything. She has the right to be mad and ask for something in return.... this lady might of damaged property, you never know... If you ask me that's a lesson learned... you should be very careful of who you let stay in your house, why and for how long.
