"The court summoned him last night." is the correct sentence. "Had", in this case, is the past perfect use of the verb "to have". It would be used to describe a past event or condition completed before another event in the past. For example, you could have said, "By the time he got home last night, the court had summoned him." While I'm sure we all understand what the original sentence means, it is grammatically incorrect.

"Had" implies that the action is the background to, or reason for, another activity. For instance "He had to appear because the court had summoned him" or "He explained that the court had summoned him."
