    My Boyfriend Owes Back Child Support And They Withhold His Taxes Every Year To Pay This If We Get Married Will They Withhold Mine Too?

    No, if you're another individual in the sight of tax authorities then they would not withhold your tax if you'd get married with that person. So you should not worry about that.

    in the state of california they can and will with hold your tax return if you are in arears it happened to me

      Unfortunately, Tausif's answer is incorrect.

      If you are in a community property state, check with the IRS or the Child Support Enforcement (CSE) agency to see whether the spouse's share of the refund is exempt from the offset or not. In some states, you may not be exempt. Click the following link for addresses and telephone numbers for CSE offices/directory: Child Support Enforcement Contact Information and Directory.

      In NON-community property states:
      If you file a joint return and only your husband is liable for child support payments, in non-community property states you can file an amended return to receive your share of the tax refund. The person who is not responsible for the child support debt can file tax Form 8379, the Injured Spouse Claim and Allocation. You can get Form 8379 by calling the IRS (listed in your telephone directory) or by visiting the Treasury Department website at: US Treasury Dept. Follow the instructions on Form 8379 carefully and provide the required documents.

      I agree with the previous answer (amore01). I would also suggest that you keep all of your financial matters separate from his when you get married. That includes not having separate bank accounts and filing your taxes "married filing separately". This may help you too.
