    If I Am Paid Salary, When Should I Get Paid Overtime? I Sometimes Work 60 To 80 Hours A Week. Should I Get Overtime Pay Or Comp. Time?

    I may be at the wrong place but I am trying to find out if I should get paid over time if I work over a certain amount of hours in a week even if I am paid salary. I am in the construction business and we do paving I am one of the paving supervisors O just want to know about the overtime pay and if I shoudl be receiving any?

    It depends on whether or not you are paid by the hour. If you are an hourly wage earner, you should be paid overtime or earn comp time after 40 hours. As a supervisor, you may be getting paid a flat salary. By that i mean you get paid for the year regardless of the hours you work. You could miss a days work and still get paid, whereas a worker who gets paid by the hour would lose an hour's salary for every hour of work missed, unless there is some kind of leave policy.

    Comp time is illegal for those not in the public sector. While a lot of employers use it, or at least allow it, only public employees a re legally allowed the use of comp time.
