    Is It Legal To Get A Covenant Agreement After 3 Years Of Being Employed With The Company In The State Of New Jersey?

    I have been working with a company for three years and last week I received a restrictive covenant agreement. I thought this was only given at the time of being hired. So I would like to know is it legal after 3 years and does the state matter where its given?

    It is legal, and generally, no, it doesn't matter that you are in New Jersey. You have the option of signing it, of course, or not, but you may be at risk of losing your job with the company if you refuse (depending on what the company's policy is). If you sign it, the agreement will be effective as of the date of mutual signing, unless otherwise specified. The covenant agreement covers no prior period unless that is specified in the agreement itself (which may be unenforceable anyway).
