    Can A Landlord Keep A Security Deposit If Before The Date You Move In , You Cannot Move In And Let Him Know This? No Lease Was Signed, Just The Check Given To Him, That He Already Cashed?

    I was going to move into this apartment, gave the guy a check for 200.00 to put a hold on the apartment, then found out that I could not move after all. When I called him, he stated he already cashed the check! I asked him for the money back. No lease was signed, only the application for the apartment, now he won't give me my money back, without even moving in!

    The thing is once you have paid the security deposit and you change your mind about moving in, the landlord can keep the deposit. This is the standard rule. However, you can move into the apartment on that security deposit as there had been a deal between the two of you. But since you didn't sign a lease and there is no record of the money you have paid. You wont be able to justify it in a court. So I suppose consider it as a lost cause. Or consult a lawyer for more details.
