Can I Be Evicted In Delaware With Two Eight Month Old Twin Babies?

I have a court date for summary of possession. Can I be evicted with 8 month old twins? I am unemployed and going through hardships. Also there are problems with mold in the unit that reoccur, the realtor and landlord insist it is not mold. If evicted for summary of possession, how much time do I have after the court date?

    You can be evicted if you don't pay your rent, regardless of whether or not there is children involved. The landlord is not responsible for you, or your family. You and the landlord have a lease agreement. Which is basically a contract that states you will pay rent in exchange for a place to live. The judge might deduct rental monies for the landlords failure to maintain the apartment. However, mold will not excuse you from paying rent. You need to bring proof to court of all the rent you have paid thus far, and any correspondence between you and landlord regarding the mold issue. If you didn't notify him/her in writing it will be your word against his. The judge will probably grant you more time, and may offer that you apply for government subsidized housing. However, unless you can show clear evidence that the landlord was in default of his/her end of the rental contract you are going to be ordered to pay.
