It entirely depends on the policies of the company. If the company policy states that illegal are not allowed to work then you can ask the desired person to submit their resignation or they can be fired on violating the company's policy. Another solution is to politely ask the employee to leave so that the company as well as the individual does not fall into any kind of mess. Or you can be very obedient to your country and inform the officials of such a situation.
