Can Tenant Request 7 Days Rent Back For Leaving Early & Giving 1 Day Notice In NH?

I agreed to rent a room in my home to a person that is planning on moving out of state as long as he prepaid for 2 months. He did and then gave me a 1 day notice and wants me to give him back 5 days rent since he's leaving early. What is NH law on this? No written contract and no security deposit.

    It would be a wash in court. Neither of you played by the rules. You need to be extremley careful because if he paid by check or any other means other than cash, he has proof of a rental agreement by you cashing it. He could squat and it would take months for you to legally evict him. Don't ever do verbal agreements. Always in writting and be specific. give him back his 5 days as good faith as he showed by paying you in advance. You knew he was leaving so it really wasn't a surprise.

      I agree with septic here. There was nothing in writing and therefore nothing to hold up in court. You knew he would only be there for 2 months and he left a little shy of that..?  Give him the 5 days  as good faith like septic says and be done with it, lesson learned. Always in writing.  Always, always, always.

        I have never seen or heard of anyone doing this. I don't know any landlord that would agree, lease or not.
