    My Ex Is Behind On Child Support..over $25K In Arrears. He Also Has Student Loan Debt That He Doesn't Pay. If He Files Taxes, And Has A Refund, Does Child Support Collect First, Or The Student Loans?

    The student loans were taken out prior to the child support case.

    Child Support trumps ANY loans. If you haven't already, go to Child Support Enforcement and file against him. His refund would come to you then. They will also garnish his pay for your monthly support.

    It depends on what state you live in. My friend is in the some position as you and the government took the loan and she got nothing. But she also went and had his license revoked and a listed as a deadbeat dad.
