If A Man Signs A Birth Certificate And Is Not The Father Is He Still Responsible For Child Support?

Answer Question

2 Answers - Sort by: Date | Rating

Being that he did sign the birth certificate and you two were not married he was acknowledging that he was the father. Legally until the father is made known by the court system he should be required to pay child support. After the correct father is established by the courts the man who is determined as the legal father should then be placed on child support. It is usually a long and tiring process.

Was he your husband at the time you gave birth?
If he is on the birth certificate and you are not married, and he has obtained a DNA test to prove he is not the father, then he can go to court and get child support payments stopped.  He is not responsible for the child legally.  He can also sue the mother for child support paid.
