Can I Refuse To Pay The Rent If The Landlord Has Been Notified In Writing Of A List Of Complaints Which Make The Dwelling Uninhabitable Under Current Law? Ie; No Smoke Detectors And Severe Roach Problem.
We moved into our apt. Two months ago. The apt was filthy and infested with roaches, + no smoke detectors. We sent written notice of these problems to the landlord. We left messages stating our intention to move and not pay rent on an uninhabitable apt. We were answered with a three day notice followed by an eviction suit and set for trial. We have video evidence of the roaches and a fire dept. Inspection which found the property management company in violation of fire codes. Can we legally withhold rent due until our needs are addressed under California law?
