Can My Landlord Change The Locks Before I Have Moved All My Personal Property Out Considering That I Paid To Stay A Month Longer After My Lease Was Up?
My lease was up in May. My landlord agreed to let me stay a little while longer until my new place was ready to move in. We agreed on a date and I paid him rent & utilities for the extra time i was staying over (17 days). I had to leave town for 2 weeks in which time he changed the locks on the 17th day with all my property still in the unit. I had movers & family there on that day to move me but could not because he would not return anyone's phone calls to let them in.

I don't think he can legally do this unless he had you served with an eviction notice. If not, you might be able to call the police to make him let you in to retrieve your belongings. You really NEED to call or go and talk to the landlord/tenant board to find out if what he's done is legal. Then pursue it from there, as I think you might be able to sue. Hope this helps you out. The laws are pretty much similar in most states...since your lease was up, you were then on a "month-to-month" basis, in your case days. By that 17th day, you should have had your belongings out! you are actually stopping him from renting it out to some one else. By that day he could have had your property removed at tour expense, so he could prep the apt. For new renters so he wouldn't lose any money. Sorry, but when you wait until the last second to remove your things, he can take you to court for un-paid rent and LOCK YOU OUT until you pay him for the NOW extra days. And lost $$$$$...your best bet is to leave him a message on the phone and let him know you will pay for the extra days. Send him a certified letter stating you are willing to pay the extra money( make sure you make a copy and keep the original for yourself, keep in mind, most cases are lost for lack of proof of evidence and keep all of your receipts, and any and all paper-work), if he does-not accept the letter or still refuses to let you in, then you can take him to small claims court...sorry, but by taking everything down to the last minute, you are at fault ! you could still get stuck with all kinds of fees for being late removing your property.
