I think you should level with him upfront ,and tell him you have not sold your home as you had hoped. That is the most logical thing to do, because if he pursues you in a court of law ,it is likely to be long and costly for him, and he will not be able to resell it, while this is all going on.
There are purchase agreements that allow for the sale to go through dependent on the selling of the new owners original property,however if I understand the situation correctly this is not the case with your situation.
You do not mention the time period involved and whether either he or yourself, would be prepared to wait a little longer, or if you have changed your mind.
I feel that the only way out of this is to discuss it with him ,and both lay your cards out on the table.
