Who Pays For Damage To My Vehicle?

I purchased 4 new tires for my SUV and drove 13k miles before learning that one was the wrong size. I had to have the transfer case and rear differential replaced. The business said they would take care of my bills but the insurance company is offering 50% of the cost of the parts since they were new parts instead of used parts used. My truck had 187k miles. Are they legally required to reimburse me at 100%? I also had to rent a car for a week during the repair. Should they reimburse me for that as well?

    I am having a hard time believing that one tire being the wrong size(you couldn't see the difference?) caused all of that damage.
    I have seen 4 wheel drive trucks with 4 different sized tires run on them for thousand of miles with no ill effects.
