    It would be under estimation to regard the monarch as having no say in statecraft. Being the head of the state, she has an important constitutional role to pay. She has certain prerogative which can be exercise in her own discretion. After the resignation of one government, all the political authority is transferred to her whom she delegates to the new cabinet. Normally, she remains imperial and indifferent regarding the formation of the cabinet; it is her sole discretion to decide which party commands majority in the house in order to invite the leader from the cabinet.

    Under the circumstances when no party in the house commands clear-cut majority, the sovereign can ask any leader to form the cabinet. The sovereign performs an important role in the formation of a coalition government. The clear example is the formation of national government in 1930 when the king played important part in the selection of ministers. The dissolution of parliament and calling for fresh election is another royal discretion. In order to counteract the hostile attitude of the House of Lords against a government, the sovereign can appoint sufficient number of new peers.

    Another important aspect of the `rule of law` lies in the  fact that fundamental rights of the citizens are in the larger part, creator of certain rules of constitutional law. In case of clash between the two constitutional laws has to be adjusted within the requirements of fundamental rights.
