What Is The Difference Between The Legal System And A Constitution? How Are They Similar?

    The constitution is basically a fundamental set of principles by which a country will be governed.  In a sense the constitution is both the foundations and the overarching umbrella for all other legislation, including the legal system.  The legal system has to comply with all the requirements set down in the constitution.

    The legal system is the details of how these principles will actually work in practice.  So, for example, if all men are born free, then the legal system will actually provide the basis for how this can happen on a daily basis i.e it will introduce laws to ensure compliance with the constitution.  The legal system also sets out what punishment will befall anyone who breaches the law and therefore the constitutional rights of another person.

    Both the constitution and the legal system give people rights and so in this way they are both similar, although the constitutional rights are the most important.
