    If I'm On A Month To Month Basis And I Have To Pay Rent No Later Than The 5th Of The Month Can I Give A 30 Day Notice On The 3rd Without Penalty?

    I am on a month to month basis and i gave a 30 day written notice but i did it on the 3rd of April and will be moving on may 3rd can they charge me a full months rent for not giving the notice on the 1st when i have until the 5th of every month to pay rent?

    Usually, rent is due on the 1st of each month (barring any negotiations you may have garnered with your landlord). The additional 4 days is considered a "grace period". If charged for anything, it would be May 1st thru 3rd. This 30 days is usually asked for to advertise an upcoming open space, and hopefully time to clean before the new tenant occupies.     Each state has it's own laws concerning real property (real estate). Some are Renter friendly. Others are landlord friendly. Most have statutes concerning giving notice. I my state for example, a month to month lease requires only seven days notice. However, the rental agreement may designate a longer period.

    Your best bet is to talk to an expert in your state.
