Can A Landlord Change An Agreement To The Lease?

We have lived in this apartment for 3 yrs. We pay rent electric and garbage removal as stated in our lease , our landlord pays heat and water. Now he wants to change it to electric heat so we will no longer have heat included and he doesn't plan on adjusting the rent. He said since he has increased it since we have lived here there was never anything in the lease about a rent increase.

    You need to go to the landlord/tenant board and talk to them about this. It hardly seems fair to be doing this to you. They are there to help with disputes and to help you know what the law is concerning your situation. Hope this helps, good luck.

      Have you recently read your lease?  Does it state the landlord will pay "heat" or "gas" (or other heat source besides electric)?  If it says heat, you may have some leverage here, even if you might otherwise not.  Words, like all details, are often the difference between wining and losing.  But you will have to do as tiggersmom says and talk to someone on the tenant/landlord board, or whatever such agency is in your area.  Legal aid might be able to help as well.

        As far as I have ever known the only time he can change the lease agreement is when your lease is up. I think he has to give a reasonable time frame (or unreasonable 30 days or so) to tellof the changes. It also varies state to state and county to county. I would talk to the board like she said and find your rights in your area.
