    Check what the statute of limitations is for the state. The statute of limitation is the time limit for the creditor to initiate a law suit. The statute commences from the date of the last activity on the account. It does not commence from the time of the opening of the account. If you are a victim of ID theft, then you should get the copy of your credit report. If the items listed in the report are not your transactions, you can dispute it with the credit bureaus. Remember that you are entitled one free annual credit report every year from credit reporting agencies. Take it along with you when you meet the attorney. However if you have a lot of outstanding debt for your credit card, then you will have to negotiate with the credit card company in order to avoid the law-suit.
