 I hit a cow in my work truck. The farmer is fighting, saying kids opened gate. Truck written off - market value way short of buying a vichele to do same job. Ian i sue for loss of vehicle cost and loss of work with out truck?

 Hi there! Legally I think the farmer is responsible for the cow being on the road. He is liable if the cow is on the road. Problem is most farmers don't have much of a cash flow and usually all their money is tied up in stock and farm equipment.

Was he a reasonable fellow who could understand your situation or an aggressive uncooperative fellow?

Unfortunately there is usually a shortfall between the amount of insurance you have on your vehicle and the replacement cost.

You could seek help from a legal advice service and see if they can recommend whether this matter is worth persuing or not. Sometimes it costs more in legal costs etc than it is worth to gain the extra compensation to replace your truck.
