    Can You Help With A Legal Question About Foreclosure?

    Me and my husband claimed bankruptcy chapter 7 2 yrs ago. Our house was placed on the chapter 7. However we continued to make the payments until they raised them. No affirmation papers were signed.. However we received a notice in the mail about a hearing of default... Not sure what it means and if we have to attend. Can someone help me with this? Thank YOU

    If there is a notice of default you had better attend as it means someone is attempting to repossess the property as the payments are in arrears. You should also seek legal counsel where you live as they will be able to better explain and review the issues. If you do not care that a repossession may take place on something that you may still own or reside then don't go but you will be deemed in default pretty much by your absence. Anytime there is a court issue and you are one of the parties it is advisable to attend to protect your rights and interest.

      Seems to me that you were making your payments until they increased the payment. If you don't make the full payment they can still foreclose on you.
