    First call she probably had insurance that pays it off.

    Did she have a will?

    If not in most places Probate or YOUR will lawyer will split up everything after all bills are paid off!

    If not depending where you are at it's the family's responsibility to pay it off.

    Ask a probate or will lawyer in your area! Or call your local legal aid!

      Absolutely do not just take the car to the finance company(ies).  Your first concern may be that the payments are coming due.  The first thing to do is obtain a certified copy of her death certificate.  Your funeral director can get you as many copies as you need.  If you are not sure how to go about this - just get a phone book and call any funeral home - they normally are happy to advise you on how to get these certificates.  

      What you do is send a death certificate to each finance company - and anyone she owed payments or money to.  This will 1 stop any collection action, 2 start any insurance procedures for the bill in question, and 3 pretty much keep you insulated from any responsibility - until probate can be processed and taken care of.

      IN almost all state you need an attorney to handle a will and probatel.  The length of time for probate to be fulfilled varies; sometimes it is over in just a few months.......and occasionally it takes a year or more.  A lot of this depends on if there is a will or not and the value of the estate (assets at time of death).
