 Can I Withhold A Portion Of The Rent For The Expense And Inconvenience Of No Electricity For 2 Weeks?
I began renting a house 4/18/08. JEA told me that since the house was empty for over a year, I had to get a licenced electrician to do an inspection. Our electricity was turned on 4/29/08. We spent two weeks( with two kids, and I am 6 months pregnant) with no electricity except for an extension cord from the neighbors that the landlord set up. Then, we realized our refrigerator was broken. And the air conditioning is not working properly. Can I deduct a portion of the rent from this months rent?

 The fact is you should have checked the house properly, before moving in. Now you must have signed the lease and doing that means, you have agreed to take the house in its present condition except any stuff mentioned in the lease. However, you must be compensated for all this trouble. You should talk to the landlord about this and come to a mutually agreed decision. Or else talk to your lawyer about what course of action would be best.

 Wow, 2 weeks? Per the fair housing codes and the Tenant/Landlord Act, the landord is required under the Habitability Warranty to maintain electricial, plumbing, heating & other rental facilities & appliances in resonably good working order.

The Warrant & your local ordinances provide that the tenant has the right to withhold rent to the landlord for failure to maintain repairs.

You really need to take this guy to civil court. And the best thing you can do would be to put the rental money in an escrow account until the case goes to litigation. When the judge asks if the money is available, bingo, you'll have it. I know the judge is going to order you the money.

Look in your yellow pages for attorneys dealing with fair housing laws. You are allowed a free consultation with most of them. You can then go from there.
