How Can I Have My Husband Adopt My Kids?

I have been married for three years now and the father of my kids had visitation rights but moved away and has not seen or talked to the kids for two years now. My husband wants to adopt them. How do we go about doing it since the real father has moved away

First, the father has to agree . so if you have any contact with him you should explain to him what you and your husband have in mind .explain to him that (GOD WILLING NOTHING WILL) if something would happen to you in a case were you could not provide your children the care they may need, you husband could provide that care if he were the adoptive father. with the father having moved away your children may have no one who can make decisions on their behalf if you were not able to do so. and small children would need some one who they know, who will take care of them until you were able.

I agree with Becca. The biological father would have to terminate all parental rights then the adoption can go through.
