There are two things that you would have to do to ensure that your niece comes home to you, now that she is with child protective services as your brother is incarcerated. The first is to show that you are indeed a blood relative of the child and are willing to take her in and look after her till your brother is out. Once you have established this, you need to be able to prove that you have the ability to provide good care to the child. The whole thing is process driven, and can bog you down at times, but it is essential, for the sake of the welfare of the child.

The child protective services would come and check that you are actually able to take care of the child. In many cases the courts would get involved as well, and it could take a while. However, if you are serious about taking care of your brother's child, and show the authorities that you have the enthusiasm, ability, and the means to look after the child, you should be able to do this.

Get a hold of the department of health and welfare and talk to them about how you could get the child. That is is what i did.and i have now adopted my niece.
