If A Father Receives Only Ss Does He Have To Pay Child Support?

My son receives social security for an accident he had and his son also receives a check on his behalf but they also take $100 of my son's check for child support does he have to pay that?

    That depends on what is in the divorce decree. If he is responsible for more than what is being paid by SS, then he has to make up the difference. The only way to change it is to take it back in front of a judge and get the decree modified.

    Sounds like your son is in a heck of a mess. He shouldn't be taking money away from his child as it is his responsibility to raise the child just as you raised your son. I know the thought is always that the ex receiving the child support money is going to use it for other things but the government has put a base line cost on what it takes to raise a child and then the judge looks at the income of each person to decide how much each has to contribute to that figure.

      According to the judge from where I live they can not include your SS on determining your child support. It is based on your monthly wages only.
