If People Speak Spanish As Native Language Do They Come Under Latin American Or Not?

It depends on who you ask, but in general, in the U.S. When we refer to Latin Americans, we pretty much mean everyone in the Western Hemisphere who natively speaks Spanish, Portuguese, and possibly other languages, other than English.
However, it is not just simply the language spoken at home, but also the fact that they have genealogy going back to the Latin European countries, and again, this depends on who you ask. Definitely Spain and Portugal, possibly Italy, and maybe even France and other "Romance" speaking countries.
French Canadians would very, very rarely be considered Latin Americans, and yet, French speaking Haitians might be.
Labels such as this are quite sloppy, as are others like "Romance language" or "latino" or the fact that U.S. Citizens get referred to as "Americans"
