    Is My Landlord Legally Allowed To Keep An Overpayment?

    My landlord recently notified us that we hve been overpaying our rent by $20 and that we have been since june but they are legally not allowed to give us our overpayment because we did not question the rent increase

    First of all, how do you forget to pay more rent. It is a mistake on your part. Secondly, if you have payed more mistakenly then the landlord should return the money to you. It is illegal in my opinion. You can ask for your excess paid money and you have every right so.

      The rental price should be listed in your rental agreement. If you have been overpaying, then they should apply it to the following month's rent. You can easily underpay it by the amount you have already paid and the landlord does not have any grounds to retaliate because the fees were paid in previous months. Just have all your documentation to back it up in case they get a wild hair to try to take you to court or something.

      when my lease was up the leasing department said that they were too busy at the time to resign my lease that they would call me when they get an opening. they sent me a letter stating that my rent would increase if i didn't sign a lease and again i tried to get into the department to do it and they told me that they were too busy they increased my rent anyway. now the office is being run by other people and they realized that they made a mistake and decreased my rent to the original but stated that they can't legally give me my overpayment due to i never questioned the increase and that its my word against theirs
