This Question Is Answered:
Can A Landlord Serve An Eviction Notice Back Dated From The Date Served?
I currently reside in North Carolina and came home to an eviction notice on my front door. Reason was failure to pay rent (which I tried to pay to landlord)and letting someone move in without permission. I had friends over for a weekend (two nights) no one moved in. The eviction notice was on the door today, May 8 and was dated May 5. When I questioned her she said she didn't have time to deliver notice. What are my rights involving this matter, any help will be greatly appreciated.

The eviction notice must be delivered to the tenant on the date mentioned on the notice. If not so, the notice is effective only from the date of delivery of the letter. It is actually the responsibility of the Landlord to deliver the letter on time. You legally have your eviction time from May 8 onwards and thus by law he cannot evict the property before the specified time period starting from May 8.
