Expungement is basically the sealing a criminal record so that the public cannot access it. It is an American legal procedure and the procedure for doing the same will vary from state to state in the United States of America. Actually any person who has been charged with some kind of criminal offence is eligible for expungement with the exception of a minor traffic offence. You can file a petition for expungement in case you have been found not guilty of the charge, the charge was dismissed, the state attorney did not prosecute your charge, your case was settled, or you were convicted of a criminal act but were granted pardon for it.
The period before filing a petition for expungement varies considerably depending on when you filed a general waiver or a release form and how your case was concluded. The entire process of expungement may take a maximum of ninety days from the day you file your petition- if there is an objection to your petition then the court will hold a hearing regarding the same.
