    I Am Not On My Domestic Partner's Lease. Common Law Is Not Recognized In NY. He Is Currently In The Hospital. How Long Before He Loses His Apartment, And How Long Before I'm Evicted?

    I am living as common law for 4 years,which is not recognized in NYS. I am not on his lease and he is currently in the hospital. He may be in for an extended period. As long as I am paying the rent, how long before he loses his apartment., and how long before I'm evicted? Is it possible for his family to take over his apartment or even enter it without his permission?

    As long as you are paying the rent you can stay until the lease expires. Is your partner capable of resigning the lease when it comes due? And yes, someone from his family may be able to take possession not only the dwelling but all possessions in it, but only if they have a valid power of attorney or court ordered ga. When couples enter into a relationship and move in together they do not want to think about situations like this happening to them. It would be the smart and mature thing to give each other a power of attorney so that one of you has full say in the direction of the others wishes. Also a living will is something to look into. When the lease is coming up to end you may want to go to the management and explain the situation and have your name added if they will allow it. Many places would rather have the rent coming in than a place sitting empty. Good luck.

    I agree because they want the rent payment they don't care who pays it, the place is occupied and rent has to be paid,pay the rent and all is well. Peace

      He shouldn't ever lose it as long as you keep paying rent. His family cannot take it over without the proper legal proceedings. That living will is a very good idea.
