No he can't. If you move take him to court before you move let the judge know your leaving the state and if you have a good reason like you want to be around family so you;ll have more help or your getting married and your husband job is there or if your ex is abusive and you would rather be around family to make you feel safe there are many reasons but if you just pick up and leave no he can't stop you but he might if you tell him when and where you'll be. My advice is if he is a good father or a mother then go to court and get half custody that makes you responsible to have them in the summer then sent them back because the judge is looking at thats there mother and children need there responsible if she has had them all there life so it goes both ways. Look at the whole picture if your a good father take her to court if your a good mother go to court you'll see a mediator before you see a judge this is when you both decide whats best for the kids not yourself so don't be selfish. Hope that help you. I went through the same thing except my ex was a dead beat daddy and trying to make me miserable. It can really nasty going to court and very stressful not only to you but to the children as well good luck.
