How Do I Patent An Invention?

Answer Question

3 Answers - Sort by: Date | Rating

A patent is an exclusive right to the inventor's property. It excludes others from manufacturing, reproducing, and selling your invention for a set period of time. There are three types of patents and they last for different time periods. Once the prescribed time elapses, the patent expires and the invention becomes public domain. In order to apply for a patent, you contact the Patent Office and get the necessary application. There are fees you must pay when you submit your application and, and they may be quite costly. Therefore, you must be serious about your invention before you proceed further with it. There is no guarantee whatsoever that you will get a patent for your product even when you have applied for one. As soon as your application is sent to the Patent Office, it will be thoroughly examined by them. If your invention passes all of their scrutiny, and is found to be an original creation, and, you have paid all of the necessary fees, then your patent will be granted. But, on the other hand, if the Patent Office finds similarities in your invention versus an already patented invention, you may be required to change your invention. Anyone can obtain a patent, as long as their invention is not too close in structure, or, is not too similar to another invention that has already been patented. Your invention must be new, and not just a spin-off of another patented product.

There are basically three different types of patent that you can apply for. They are either a utility patent, a design patent, or a plant patent. In order to get a patent you have to simply get in touch with the patent office and fill in all the required applications. You will also be required to pay in a certain amount of fees. The fees are generally very expensive, so do think about your patent before you plan to get a license for it. Once you send a patent it will thoroughly be scrutinized as to whether your invention deserves a patent. Incase your invention turns out to be similar to other products you will need to make alterations or changes as desired. You will need to go through certain books that actually provide you guidelines on how to get your patent licensed.

If you want to patent an invention, you must first fill up a written application by yourself at the patent office that is relevant to you. A patent is the set of exclusive rights that has been given by the state government to the intended user only for a set time period just for a public disclosure of his newly-invented product. It serves as a "right" that has been given to the inventor which has found out some useful products or have created a new machines that can help mankind. There are several types of patent, including chemical, plant  business and software etc. If you need a permit for a patent, you need to fill up a application form yourself at the patent office that is relevant to your newly-found product. You must in this form, describe how you make or use the particular product, with sufficient details about the product, like the materials, or surfaces, or usefulness of it. After finishing the form, you are supposed to sent it to the relevant patent office for review and analysis, to check if this product fulfill their requirements before they are  shipped to the outside world. If it is rejected, or even brought to court for plagiarism of another user's product, it is liable for damage and compensation.
