How Much Notice Is Required In Calif To Give Tenant Before Listing Home For Sale?

    There is no requirement in California to give notice when listing a home for sale.  But you do need to give the tenant 24 hours notice to show the property, and do so within 'normal business hours', or with their agreement.  To have them vacate, you need to give them 30 to 60 days notice if they're on a month-to-month agreement.  (30 days notice if they've been there less than a year, and 60 days notice if more than a year because of a new law effective January 2003).  Otherwise, you'll have to follow the terms of the lease, perhaps by having the new owner become their landlord, or by negotiating an amended agreement with the tenant.

    That said, you do need to be on good terms with your tenant.  Give them some sort of incentive to keep the place tidy and make sure it shows well.  Perhaps give them a break on the last months rent, or help with their deposit on their next rental.  An angry tenant can devalue the place just by keeping it messy and by being uncooperative during the interruptions to their life during showings.

    Also be aware of a new California tax law that requires withholding 3 and 1/3 percent of the sale price for non-owner occupied properties over $100,000.
