      Murder, in legal terms, is the "unlawful killing of a human in being under the Queen's peace" with malice aforethough. This means that for a murder to be committed, a person must kill another person, with intent (under the Queen's peace means that it is permissible to kill an enemy soldier in times of war.) A killing without intent is manslaughter.

      Attempted murder is therefore intending to kill another person, but causing a lesser degree of harm, and the victim surviving the attack. The difference between a charge of GBH and attempted murder would be the intent of the attacker.
