What Are The Rights Of Spouse Listed On Deed But Not On Mortgage, Can She Purchase It At Auction?

    Almost anyone can be on a mortgage, but the individual on a deed owns the home just like you may.  There's no need for her to purchase at auction, she is already an owner and shares that ownership either equally or unequally.  This will likely be for the court to determine, if that's the route you're going towards.  You're unable to sell the home or refinance without all signatures from individuals on the deed.  The mortgage is just something from a bank giving you money; the deed/title is what's important.  If you were to default on paying the mortgage, the spouses credit won't even be affected.  Tread carefully!
