    If Parental Rights Were Terminated For A Parent That Is Incarcerated, Can The Adoption Of The Child Be Overturned Once Inmate Is Released?

    I am a sister who has a brother who is in jail and he will be released in March 2009. His daughter is 11 yrs old and she was recently adopted by her mom's male cousin. My brother's parental rights were terminated while he was in jail. Is it possible to overturn this adoption?

    I am not sure what state you are in but usually adoptions are legally binding and can not be overturned because suddenly the birth parent can take care of the child. There are a few rare cases where the adoptions have been overturned but they have been in extreme cases. Most judges stick with their final ruling.

      I am a foster parent who was in the process of adopting a son and the childs dad is in prison and mom couldn't care for him. They both had to give up there rights so if you signed his rights over they will not over turn it. And unfortunately given the fact your brother is in prison I doubt the courts would consider it.

      No, the fact is that they have NO PARENTAL RIGHTS ANYMORE! Let the child have a chance at a decent life!
