Is It Legal For A Company To Work Employees Overtime While They Have Other Employees Laid Off?
I'm laid off from a company that is working employees 45-50+ hours per week. How can I be laid off for lack of work?

In the state I live in, it is legal for them to require or ask for voluntary overtime. However, you can't hire someone else as long as those employees are still layed off. Is the overtime every week, or just occasionally? Is is ALL employees or just a select group? There are a lot of things to be considered when comparing what these individuals make during OT to what you made/make. It could still be a savings to the company. I've been laid off from 6 jobs in the past, and it ain't fun. I know how hard it can be. Been there done that and I think it's about to happen again within the next year. Good Luck, Janes

It has been 3 out of 4 weeks now for all employees. They say they still save money doing this, but I think it should not be legal for them to do this. They are paying out enough on overtime to pay at least 4 other people straight time.
But, they are saving what they pay for your insurance, the additional taxes they pay on your salary, the workmans comp they pay in addition to your pay, the unemployment taxes they pay on your pay, etc. Those are things we don't see that they are taking into consideration as well.
