    Can A Landlord Evict During The Winter?

    My landlord has not fixed the windows in the basement where my sons sleep. It temperature is below freezing and it is in the middle of Winter. We live in Montana and the winters cal get really cold. We are two months behind on the rent. Can he evict us? Also can I use as leverage that he did not fix the windows which are completely gone. My utilities have gone way up due to the broken windows.

    According to a law, a landlord can evict a tenant at the end of the tenancy agreement or at the end of the lease. Even if the end of lease is during the extreme winter months. But if he is evicting you prematurely, you can complain to the concerned authorities.

    The words that "windows are completely gone", does it mean no glass, no nothing to cover? If it so, you can report this to authorities as well as to get the partial reimbursement of the utilities bill.
    The landlord may also face a financial difficulty, which may fix the window with your rent.
    Both parties do not seem to carry out their responsibilities well, which makes it hard to avoid penalty for both parties.
    Landlord can evict the tenant for non payment, regardless the lease is not expire yet.
    It will take several steps, which includes to face a trial. Usually, the judge will give the tenant chances to make a rent agreement to catch up. If the tenant doesn't follow this agreement, then landlord will report it to the court and/or lawyer again. Furthermore, tenant will be given several days to pay the rent. Until the dateline, the tenant still doesn't follow the agreement, then a Sherriff will sent for a lock-up.
    Tenant will only have chance 1X to pick up the belonging from the apartment/house they rent. 2 months behind is a big money. Please try to wear the landlord's shoes, if landlord is late to pay the mortgage, landlord will have to pay the mortgage late fee, please it will make landlord's credit score down. So, be nice to the landlord.
