Cobra Insurance Question Is This Legal?

My sister paid her cobra in November-wrong amount-she made up the difference along with her Dec payment-paid her Jan payment and was dropped in February because of the shortage in November, since they accepted Dec and Jan -is this legal?

    I believe that the law says that if you miss a payment or don't make the payment IN FULL you can be dropped.  As far as them accepting two further payments.  The people processing Cobra payments are not the same people who made the decision or sent the letter saying she was dropped. It probably took awhile for the system to "Work" and notice the deficient payment in November.  Meanwhile she added more money to December to cover the shortage but by then it was too late.  In the eyes of the insurance company she failed to make her December payment "On time" and "In Full" so they dropped her.  The fact that they took two more payments from her probably doesn't matter.  Her employer ( most likely)or the insurance company got those next two payments--accepted them--NOT knowing the drop was in the works--or maybe  Standard Operating Procedure would be to accept her payments UNTIL the EMPLOYER received notice that she was dropped.  She could try to get some money back but I don't believe it will work.  They would probably SAY that she is "lucky that this didn't happen quicker"--because she "payed for --and got-- two extra months of coverage".  The rules (laws) concerning Cobra don't leave room for error.  I always warn my departing Employees to be VERY careful to get there payments in on time so they don't loose their insurance.

      COBRA health insurance is a leading provider of Temporary Insurance. There must be some policy regarding the late payments, missing payments and the wrong amounts.
