    My Daughter's Car Was Repossessed On Sunday Due To A Payment Check That Didn't Clear In Time For Payment Since Then They Are Giving Her The Run Around. They Told Her To Let Them Take The Car And She Would Get It Back On Monday Morning. It Is Now Tuesday And She Doesn't Have It. This Has Caused A Great Deal Of Trouble Because She Needs Her Car To Get To Work. What Are Her Rights?

    Yes... They have to give your daughter the opportunity to catch up her payments, and to pay the repossession fee. Be sure she records every conversation she has with the finance company, because if you take them to court, or they try to sue you, their actions can put them in a bind. Tell her to inform them each and every time she calls that she is recording the call for legal purposes!
    What the company is trying to do is play out its 14 day repo period before they sell the car at auction and sue your daughter for the remaining balance. Her best bet, is to physically go down there with her car payment, and i would take a long an extra $300 to cover the repo fee, also she needs to take a recorder with her and a WITNESS. When they take her back to speak with her, she has to take the witness and recorder with her! I bet they give up the car pretty quick, after some blustering about making late payments, of course.
    If they do go to sell the car from under your daughter, they have to send her a letter telling her what is happening to the vehicle and how she can stop it from happening that is the law!
