There Is A Eviction...Is There Anything I Can Do About Collection Of The Rent He Owes?
There is a eviction going on since Nov. He has paid no rent whatsoever.He has been served and now his lawyer is requestion a jury trial. When I ask for the rent he keeps telling me to ask his lawyer. He has a housing discrimination lawyer. There have been interrogatories back and forth. I am not a lawyer, so I am hoping by turning the same questions back at him is sufficient. Is there anything I can do about collection of the rent he owes? Any type of motion I can file? Thanks Jane
Well have you gone to the court house and filed an eviction cause technically you can't do anything until then.If so you can still go to the court house and file a civil law suit against him for the money he owes and there is no judge gonna say that he doesn't have to pay because he was physically there and it is not fair to you.But go to the court house they'll help you they will even call a sheriff to evict him.
You didn't say that you are a landlord but I assume you are and that you have a deadbeat tenant.

Since this has been going on for 5-months, I'd say you should abandon the DIY approach and get expert help. Maybe you should engage a lawyer, a property management company, or sell the property to someone more well prepared to deal with these kinds of problems.
