 I Am On Section8 Housing, Rent Was Paid By Housing On The Fifth, Can They Lock Me Out Of My Apartment 3 Day Notice Served On The 7 Wouldn't Accept My Portion W/o Late Fees? Lock Out Tomorrow. |
| I tried to pay rent when 3 day pay or vacate was served. Management would not accept my payment of $111.00 without the late fees being paid at the time as well. They gave me a notice today saying I will be locked out tomorrow at noon for nonpayment. Housing paid $635.00, on the fifth. Can management lock me out? |

Legally I don't think they can. But I could be wrong. I did some research on the net and found a website that I hope will help you with your situation... Good luck!

I don't think they can do that either because they accepted the $635.00 partial payment. I know they can't in the state of Fl. but not sure about other states. Here, if they accept any amount of money then their right to evict you is null and void. You need an attorney to file a petition at the courthouse on your behalf to stop the eviction. So you need to act quickly. There should be a Legal Aid service in your county. They will take the case free of charge if you have a low income. Maybe you should call the housing authority also. They may be able to direct you.If they lock you out, an attorney will probably be able to get you back in. Good luck, hope everything works out for you.
