I need to know what filing status to use if my husband does not have a social security number. Can I still file taxes the same way as I otherwise would be able to?

I think if I was you I would file a separate tax return and file as married. Don't claim any income that he has earned, just yours and don't claim him on your return. If your husband is a legal resident he needs to get a social security number and file also, the IRS will catch up soon and he can get into serious trouble.

You MUST have a social security number if you are attempting to work in the US. If your husband is living and/or working in the US, he is doing so illegally. If you attempt to put him on your tax return, be ready for an audit and for the IRS to come looking for him. If your trying to stay under the radar, don't claim him and give up the additional dependant and married status as they will get you in trouble.
Of course, I have jumped to a conclusion that there is illegal activity going on here and me, being a US citizen who pays my proper taxes and monies to social security, am a bit offended by someone costing me more money in taxes and cheating the system.

Thank you for your response......Just to clarify things, there is nothing illegal going on here.....We are working on obtaining a social security number and he is not working or earning any money until the time that he does so. My question pertained more about the right way of filing taxes.....technically, I am married.....
