    Am I Allowed To Get My Security Deposit Back If I Have No Moved In Yet?

    I was going to move in but when i tried to clean the place there was bugs and mice in there and now i don't wanna move in but the landlord will not give me my security deposit back am i entitled to it?

    Unfortunately, I think that you may not be entitled to your security deposit back. I would check with a local realtor -- they may be able to tell you, and if not they should be able to tell you who you can call.

      If you signed a lease they may be able to hold the security deposit as partial payment to the remaining balance of the six moths worth of payments. Although if you declined the contract within 3 days of the signing you may be able to legally breach.

      The word is habitable and with vermin there is no doubt that the apartment is not habitable. Since you caused no damage to his rental you are entitled to the return of your security deposit. Just make sure that you send him a certified letter complaining of the vermin as the reason for not taking possession. To get your deposit back take him to small claims court or go to Judge Joe Brown. Make sure of your facts before filing including pictures of the mouse droppings and the bugs.
