    My Landlord Is Evicting Me For Breach Of Contract Because I Got A Dog As Per Doctors Instructions. I Was Given A Prescription Saying I Need A Pet For Stress. Can They Evict Me?

    The landlord says its a violation of my Lease Agreement because its a no pets community. I think being as how I have a prescription for a pet she doesn't have a leg to stand on. Please help me to become more prepared to go into legal battle with a slum lord hag.

      If the dog is recommended by the doctor then it is not a violation and your landlord can not evict you if you'd show this evidence in court. So you should not worry about that. But if it was not suggested by the doctor then surely it will create problems.

      If the agreement says that you can't keep a dog or any pet in your home then I am sorry to say that your case is weak. I know that your problem is genuine but law has no sympathies for anyone. Please read the agreement carefully before you apply in the court.

      That's a tough one..did you sign a pet release form? If so, you'd need to get legal advice..the owner should work with you on this, though.

      As far as I know, if you have a note from your doctor, stating its for health purposes (companion animal) he really cant do anything. There have been several places that i applied to that stated no pets, but as long as a doc stated it was needed as a companion animal then they could do anything.

      It really depends on how the lease is written and how a judge would interpret it. If it says not pets and you can prove that your dog is nt a pet but rather a medicine, then you are okay but from the sounds of it, your doctor told you to get a pet to reduce the stress in your life (note the word pet). It is not a seeing eye dog or anything of the sort. So in this case, the judge would side with the landlord.

      Honestly, I would believe that you are trying to stretch the truth of the matter by swaying the facts. It is these frivolous lawsuits that jam up the judicial system. Common sense says that you need a pet to help you with stress and that is totally understandable. The lease says no pets and that also is understandable. If you need a pet for stress, then you need to move as well. Sorry to sound like judge Judy but come on.
